Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied contract is signed on a Birchville rental property, all Healthy Homes compliance items need to be done within 90 days.

All information in the Statement of Compliance needs to be accurate before the tenancy agreement can be signed, and ideally it should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It’s also crucial to be aware that landlords with multiple rental properties may face additional fines for non-compliance. The most severe penalties are handed down only for serious breaches, and landlords with at least six rental properties could be fined up to $50,000 and as high as $100,000 for hearing claims.

Tenancies commenced between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is a requirement to all Birchville and New Zealand rental houses where it’s reasonably practicable to put in.
