Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Clouston Park rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

From the 1st of July in 2021, when a new or renewed Tenancy is signed for a Clouston Park rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy agreement, it could result in an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they are living in. If the property manager is unable to provide the required information within 21 days from receiving the request, they will receive an infringement notification and could be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for landlords and property managers providing a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the one who is renting the property and it could be the name of the landlord or the company that manages the property.

The information contained in the Compliance Statement requirements to be accurate when the tenancy contract is signed. It must be updated during the entire tenancy, as associated work has been completed.

It’s crucial to remember that landlords who manage multiple rental properties may receive additional fines for non-compliance. The highest penalties are handed down only for serious breaches, and landlords with six or more properties can be fined as high as $50,000, or as high as $100,000 in hearings.

Clouston Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Clouston Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included with any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to any Healthy Homes Standards that apply or will be in force during the tenancy of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All the boarding households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All homes which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Clouston Park

Clouston Park rental properties require a reliable source of heating that is able to heat the principal or the biggest living room to at least 18degC, even during the winter coldest days. In most homes, larger fixed heating devices such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater could be enough.

If your main living space is already equipped with a fixed heating source, like heat pumps, it may need a top up to be able to meet the standards. Certain kinds of heaters cannot be used to meet the quality because they’re inefficient, unaffordable to operate and/or unsafe to run.
