Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Heretaunga rental property, all Healthy Homes compliance tasks have to be completed within 90 days.

Beginning on July 1st, 2021, once a new or renewed lease is entered into on a Heretaunga rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Additionally, if a present Healthy Homes Statement of Compliance is not incorporated within the renewal, new or amended tenancy agreement there may be additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the necessary information within 21 days from being informed of the request, they can receive an infringement notice and be fined upto $750.

Additionally, there is also a fine of as much as $900 for property owners or property managers who provide a false or incorrect Healthy Homes Statement of Compliance or any other information. The person who is liable for this fine is the person who is named on the lease contract as the person renting the property which could be the name of the landlord, or the property management company.

All the information on the Compliance Statement requirements to be current when the tenancy agreement is completed, and must be updated throughout the tenancy as any necessary work related to it’s finished.

It is important to keep in mind that a landlord who own multiple rental properties may face even higher fines for non-compliance. The highest penalties are given for the most serious violations, and landlords who own at least six rental properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Heretaunga Healthy Homes Compliance Timeframes

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement in all Heretaunga and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applicable to their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords should make sure their rental properties comply to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed Tenancy.
  • All the boarding homes (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

For instance, if an open fireplace is not in use, it can create draughts. This should be blocked from. Heating Heretaunga

Rental properties in Heretaunga require a reliable source of heating that can heat the largest or main living area to at minimum 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to be fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity and have the minimum requirement for heat capacity to heat the living space in general. For most properties, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are necessary. In some instances, such as small apartments, a smaller fixed electric heater could be enough.

If the main living room already has a central heating source like a heat pump, then it might require some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Heretaunga

Ceiling and underfloor insulation is a requirement to all rental houses as of July 1st, 2019. All landlords and property managers must make sure that the insulation meets this new standard.
