Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed on a Heretaunga rental property, all Healthy Homes compliance items must be done by the end of 90 days.

Beginning on July 1st, 2021, when a new or renewed contract is signed on a Heretaunga rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the expected timeframe can result in penalties of up to $7200. Additionally, if the most present Healthy Homes Statement of Compliance is not incorporated within an updated, renewed, or revised tenancy agreement, there could be an additional fine or violation fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to supply the necessary information within 21 days from receiving the request, they could receive an infringement letter and be fined upto $750.

In addition, there is also a penalty approximately $900 for landlords and property managers who provide a false or incorrect Healthy Homes Compliance Statement or other information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the person who is who is letting the property and it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be accurate at the time that the tenancy agreement is signed, and ideally it should be kept updated through the tenancy period as relevant work gets completed.

It is also important to keep in mind that landlords who manage multiple rental properties may face even higher fines for non-compliance. The highest penalties are handed down for the most serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Heretaunga Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement for all Heretaunga and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove compliance with all Healthy Homes Standards that apply or will apply during the tenure of your rental home.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider Boarding household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2023

  • All households which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the date when the tenancy started.

Draughts are a major cause of low temperatures inside homes. A draughty home will cost more to heat, meaning wasting money and energy.

If a draft can be perceived as a result of gaps or holes that it needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the air is clear from a gap or hole or crack, then it’s most likely a gap or crack that needs sealing in some way. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that let air into or out within the house require sealing. For example, if an open fireplace isn’t in use it can create draughts. This should be blocked off. Landlords and property managers are accountable for making sure such draughts are eliminated whenever imaginable.

You don’t require to block holes or gaps in the building. For instance, small gaps around doors and windows could be necessary to allow movement of the building as the house gets warmer and cooler, to allow them to be opened and closed rather than being stuck. Heating Heretaunga

Heretaunga rental properties must have a fixed heating source that can heat the main or largest living space to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat requirements that it be permanently fixed (i.e., not portable) and at minimum 1.5 Kilowatts in heating capacity and have the minimum capacity for heating required to heat the living space in general. A Heating Assessment Tool may be used to determine whether your current permanent heater(s) are adequate or if you’ll need to "top-up" by adding a second heater. If the heating that you provide is an electric heater or heat source, it should have a thermostat. This makes your heating more consistent and effective. For most houses, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in some cases like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a permanent heating source like an air conditioner, it might just require some additional energy in order to comply with the standards. Some types of heaters can’t be used to comply with the standard because they’re costly, not affordable to run, and/or unsafe to run.

Ventilation Heretaunga

Each living space within the rental property should include at least one open door or window to offer natural ventilation. In addition, high moisture areas such as kitchens and bathrooms should be equipped with an externally vented extractor fan to remove moisture.

This ventilation standard is all about acknowledging it is that the dry atmosphere is easier to heat, and that a property that is well ventilated will be less prone to developing mould and damp.

Bedrooms, living rooms, kitchens and dining rooms are considered liveable spaces. Spaces that connect, such as the hallways are not liveable and do not need an opening window or door.

Every window, door or Skylight needs to have the ability to open to the outside, but remain at an open angle in order to allow to circulate fresh air as well as air flow.

The bathrooms in all kitchens and any other area in your house that houses shower, bath cooker or any other water-generating appliance will require adequate extractor fans that can be vented out to the outside. Insulation Heretaunga

Insulation for underfloor and ceilings is a requirement to all rental homes from 1 July 2019. Property managers and landlords are required to make sure that the insulation is in line with the new standard. In some cases, an existing insulation on the ceiling or in the sub floor space may require to be topped up or replaced.

A properly insulated home can reduce condensation and lower the chance of mould and dampness and will also make more easy for the house to hold the heat.
