Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Kingsley Heights rental property, all Healthy Homes compliance tasks have to be done within 90 days.

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed on a Kingsley Heights rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to comply with one of the Healthy Homes Standards within the period of time expected can lead to a fine of up to $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in an updated, renewed, or revised tenancy contract, it could result in an additional fine or infringement fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager is unable to supply the necessary information within 21 days from receiving the request, they could receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is named on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it should be kept updated throughout the tenancy as any necessary work related to it’s finished.

It’s important to be aware that landlords who own multiple rental properties could face even higher fines for non-compliance. The highest penalties are handed down for the most serious breaches. Landlords with at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 and 30 June 2021

  • Underfloor and ceiling insulation is compulsory throughout Kingsley Heights and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords should make sure that their rental properties are in compliance according to Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Beginning 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
