Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance work need to be completed within 90 days.

As of 1st July 2021, when a brand new, renewed or varied lease is entered into on the Kingsley Heights rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to adhere to one of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager does not provide the necessary information within 21 days from being informed of the request, they will be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty of as much as $900 for landlords and property managers who provide a false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is whoever is named on the tenancy contract as the person renting the property which could be the name of the landlord as well as the company that manages the property.

All the information on the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed. It must be updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is also important to keep in mind that a landlord with multiple rental properties may face greater penalties for non-compliance. The highest penalties are reserved for severe breaches, and landlords with six or more properties can be fined up to $50,000, or as high as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • Underfloor and ceiling insulation is required for all Kingsley Heights and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or altered tenancy contract.
  • Property managers and landlords have to keep records to demonstrate compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of their rental properties.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure their rental properties conform to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.

Heating Kingsley Heights

Rental properties in Kingsley Heights must have a fixed heating source that can heat the principal or the biggest living space to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

In certain situations, like small apartment buildings small apartments, a smaller electric fixed heater may be sufficient.

If the main living room already has a fixed heating source such as the heat pump, it could need some additional energy in order to comply with the standards. Some types of heaters can’t be utilised to meet the standard since they’re either inefficient, unaffordable to operate and/or unhealthy to run.
