Fines for Failing to Comply

Beginning on July 1st, 2021, when a new, renewed or varied tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for a Kingsley Heights rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance isn’t incorporated in the new, renewed or revised tenancy agreement there may be an additional fine or violation fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager does not provide the information requested within 21 days from having received the inquiry, they can receive an infringement notice and could be fined up to $750.

In addition, there is also a penalty of as much as $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is named on the tenancy agreement as the one who is renting the property, so it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be correct when the tenancy agreement is signed. It should be kept updated throughout the duration of the tenancy when any related work is completed.

It’s also crucial to note that landlords who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for severe violations, and landlords who own at least six rental properties could be penalised up to $50,000, and even as high as $100,000 for hearing claims.

Kingsley Heights Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is compulsory in all Kingsley Heights and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included in any renewed, new or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with the Healthy Homes Standard that apply or will be applied during the tenure of the rental property.

From July 1st 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed lease.
  • All boarder houses (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of when the tenancy first began.

Heating Kingsley Heights

Rental properties in Kingsley Heights need to have a stable source of heating that can warm the living area to at minimum 18degC even on the coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

In most homes, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are needed. However, in certain instances such as small apartments small apartments, a smaller electric fixed heater may suffice.

If the living area already has a fixed heating source, like heat pumps, it might need some additional energy to make sure it meets the requirements.
