Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Riverstone Terraces rental property, all Healthy Homes compliance work must be completed within 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for a Riverstone Terraces rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to comply with each of Healthy Homes Standards within the period of time expected can lead to the possibility of a fine up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy agreement it could result in an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days from getting the notice, the tenant may receive an infringement notice and be fined up to $750.

Furthermore, there’s also a penalty of up to $900 for landlords and property managers that provide false or incorrect Healthy Homes Compliance Statement or information. The person who is liable for this fine is whoever is named on the lease agreement as the one who is renting the property which could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance requirements to be accurate before the tenancy agreement can be executed, and it is updated throughout the duration of the tenancy when any relevant work gets completed.

It is also important to be aware that landlords with multiple rental properties could face more severe penalties for not complying. The harshest penalties are given for serious violations. Those who have six or more properties could be fined as high as $50,000, and as much as $100,000 in the case of hearing claims.

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory throughout Riverstone Terraces and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate conformance with the Healthy Homes Standard that apply or will be applicable during the tenure of your rental home.

From 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of a newly renewed, extended or changed lease.

Heating Riverstone Terraces

Riverstone Terraces rental properties need to have a stable source of heating which can warm the principal or the biggest living space to at least 18degC even on the winter coldest days. For most properties, larger fixed heating systems such as wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances like small apartment buildings the smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source, like heat pumps, it might require a top up in order to comply with the standards. Certain types of heaters cannot be used to achieve the quality because they’re costly, not affordable to run, and/or unsafe to run.

Ventilation Riverstone Terraces
