Fines for Failing to Comply

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed for a Silverstream rental property, all Healthy Homes compliance work must be completed within 90 days.

Silverstream Healthy Homes Compliance Timeframes

Tenancies established between 1 July 2019 and the 30th June in 2021

  • The insulation of the ceiling and underfloor is mandatory for all Silverstream and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records that prove the compliance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Heating Silverstream

Silverstream rental properties need to have a stable heating source that can heat the main or largest living space to a minimum of 18degC, even during the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.

The heating source needs for it to be permanent (i.e., not portable) that is, at minimum 1.5 Kilowatts in heating capacity and have the minimum required heating capacity for the main living room. Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating that you provide is an electric heater or heat pump it should include an thermostat. This will make the heating more uniform and efficient. For most houses, larger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases like apartments with small spaces an electric, fixed heater may suffice.

If the main living room already has a fixed heating source, like heat pumps, it could require an upgrade to meet the standards. Some types of heaters can’t be utilised to meet the quality because they’re expensive, inefficient or are unsafe to operate.

Ventilation Silverstream
