Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed for a Silverstream rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

As of 1st July 2021, when a new or renewed lease is entered into on a Silverstream rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with one of the Healthy Homes Standards inside of the expected timeframe can result in the possibility of a fine up to $7200. The person who is liable for this fine is whoever is identified on the tenancy agreement as the person who is who is letting the property It could also be the name of the landlord, or the property management company.

All the information on the Compliance Statement requirements to be accurate at the time that the tenancy agreement is executed, and it is updated through the tenancy period as associated work has been completed.

It is also important to remember that landlords who manage multiple rental properties may face more severe penalties for not complying. The harshest penalties are handed down only for serious breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 in the case of hearing claims.

Silverstream Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement in all Silverstream and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records of their conformance with the Healthy Homes Standards that apply or will be applicable to the rental property.

From July 1st 2021

  • Property managers and private landlords are required to ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a newly renewed, extended or changed tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Silverstream

Draughts are a major cause of lower temperatures in houses. A humid home costs more to heat, meaning wasting money and energy.

If a draught could be felt through gaps that are too large or holes or holes, it needs to be closed.

Heating Silverstream

Silverstream rental properties must have a fixed source of heat which can warm the living space to at least 18degC even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

If your main living space already has a central heating source, like heat pumps, it might require an upgrade to meet the standards. Certain types of heaters cannot be used to meet the standard because they’re costly, not affordable to run, or are unsafe to operate.

Ventilation Silverstream
