Fines for Failing to Comply

Te Marua Healthy Homes Compliance Timeframes

Tenancies signed in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory in all Te Marua and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to all Healthy Homes Standard that apply or will be applicable during the tenancy of your rental home.

From July 1st 2021

  • Private landlords and property managers are required to make sure their rental properties comply with the Healthy Homes Standard within 90 days of a renewal, new or a change in lease.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Beginning 1 July 2023

  • All homes rented by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts may lead to lower temperatures in homes. A humid house is more expensive to heat, meaning wasting money and energy.

If a draught is noticed from gaps that are not adequate or holes that it needs to be sealed.

What are unreasonable gaps or holes?

If you are able to feel external air flowing in or an unobstructed draught coming from a hole or gap that is, it is most likely a gap or hole which needs sealing in any way. Large cracks and gaps should be fixed permanently. Cracks that are greater than 3mm and allow air to enter or exit into the house need seals. For instance, if an open fireplace isn’t in use it may cause draughts and must be sealed from. Property managers and landlords are responsible for making sure that these draughts are stopped whenever possible.

There is no need to block up intentional gaps or holes in the construction. For example, tiny gaps around windows and doors could be required to allow for movement of the building when the home heats and cools, to allow them to be shut and opened, rather than securing. Heating Te Marua

Rental properties in Te Marua should have a permanent source of heating which can warm the principal or the biggest living space to a minimum of 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs to be fixed (i.e. not portable) and at least 1.5 kW of heating capacity and have the minimum requirement for heat capacity to heat the living space in general. A Heating Assessment Tool could be used to determine whether the permanent heater(s) are adequate or whether you will need to "top-up" with a new heater. Open fires and unflued combustion heaters such as small portable LPG bottle heaters aren’t considered to be safe heating options in The Healthy Homes Standard.

If the heating you provide is electric heating or heat pump, it requirements to include the thermostat. This will make the heating more consistent and efficient. For most houses, larger heaters that are fixed, such as wood burners, heat pumps pellet burners, flued gas heaters will be required. However, in certain instances like apartments with small spaces an electric, fixed heater might be enough.

If the main living room is already equipped with a fixed heating source such as an air conditioner, it might require an update to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either costly, not affordable to run, and/or unsafe to run.

Ventilation Te Marua

Underfloor and ceiling insulation is mandatory to all rental houses from 1 July 2019. Property managers and landlords should ensure the insulation meets current quality. In some cases, existing ceiling insulation or insulation in the subfloor space might need to be filled with or replaced.
