Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance work need to be completed within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on the Te Marua rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with any of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement there may be an additional fine or infringement fee.

Furthermore, there’s also a fine of approximately $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is the one who is identified on the tenancy contract as the person renting the property, so it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement requirements to be accurate when the tenancy contract is executed, and it must be updated through the tenancy period as relevant work gets completed.

It is also important to remember that a landlord who own several rental properties can face additional fines for non-compliance. The harshest penalties are reserved only for serious breaches. Landlords with more than six properties could be fined up to $50,000 and as high as $100,000 in hearings.

Te Marua Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Te Marua and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement must be included with any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove the conformance to all Healthy Homes Standard that apply or will be in force to your rental home.

Starting 1 July 2021

  • Property managers and private landlords should ensure their rental properties comply to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must comply with the Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Adequate heaters are crucial for healthy houses

Heating Te Marua

Rental properties in Te Marua require a reliable source of heating that is able to heat the living area to at minimum 18degC, even during the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health as well as their mental health.
