Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance work have to be taken care of inside of 90 days.

From the 1st of July in 2021, once a new or renewed contract is signed on a Te Marua rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within the renewal, new or revised tenancy contract, there may be additional penalties or an infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager is unable to provide the information requested within 21 days from receiving the request, they can receive an infringement notice and be fined up to $750.

In addition, there is an additional fine of approximately $900 for landlords and property managers who provide a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person who is letting the property and it could be the landlord’s name or the property management company.

All the information on the Statement of Compliance requirements to be up-to-date before the tenancy agreement can be signed, and ideally it should be maintained throughout the tenancy as any associated work has been completed.

It is crucial to be aware that landlords who manage several rental properties can face greater penalties for non-compliance. The highest penalties are given for serious breaches. Landlords with six or more properties could be fined as high as $50,000, or as high as $100,000 in hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory throughout Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with any Healthy Homes Standard that apply or will be applicable to their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers are required to make sure their rental properties comply in accordance with Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Heating Te Marua

Te Marua rental properties must have a fixed source of heating that can heat the living room to at least 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 horsepower in capacity, and must meet the minimum required heating capacity for the main living space. A Heating Assessment Tool could be used to check if the existing installed heater(s) are sufficient or whether you will need to "top up" with a new heater. Open fires and unflued combustion heaters such as the portable LPG bottle heaters are not considered acceptable heating options in those following the Healthy Homes Standard.

If the heating system you provide is electric heating or heat pump, then it must be equipped with the thermostat. This makes the heating more uniform and efficient. For most homes, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in certain instances such as small apartments, a smaller fixed electric heater may suffice.

If your living space already has a fixed heating source, such as a heat pump, then it may require some additional energy in order to comply with the standards. Certain kinds of heaters aren’t able to be used to comply with the standard since they’re either costly, not cost-effective to run, or are unsafe to operate.

Ventilation Te Marua
