Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance tasks need to be done by the end of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Te Marua rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance isn’t included within an updated, renewed, or amended tenancy agreement there may be an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or the property manager doesn’t supply the necessary information within 21 days from getting the notice, the tenant may receive an infringement letter and be fined upto $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers that provide false or false Healthy Homes Compliance Statement or any other information. The person responsible for this fine is whoever is named on the lease agreement as the person who is who is letting the property It could also be the landlord’s name or the company that manages the property.

The information contained in the Statement of Compliance requirements to be accurate before the tenancy agreement can be signed, and ideally it should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It is important to be aware that a landlord who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are given for severe violations, and landlords who own at least six rental properties could be fined up to $50,000 and as high as $100,000 in hearing claims.

When do I require to be in compliance with The Healthy Homes Standards?

Te Marua Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is compulsory for all Te Marua and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will apply during the tenure of your rental home.

From July 1st 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed or varied tenant.
  • All boarder houses (except Kainga Ora and registered Community Housing Provider Boarding house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts are a major cause of dropping temperatures within houses. A draughty house costs more to heat, which results in wasting energy and increased bills.

If a draught is felt through gaps that are too large or holes that it requirements to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the sound of a clear draught emanating from a crack or a gap or crack, then it’s likely to be a gap or hole which needs sealing in any way. Cracks or gaps with large gaps must be permanently stopped. The gaps that exceed 3mm that allow air to enter or exit from your house need the sealing. In the case of an open fireplace is not in use, it can create draughts. This should be sealed from. Property managers and landlords are accountable for making sure that draughts from the fireplace are removed in the maximum extent possible.

You don’t need to block off holes or gaps which are part of the construction. For instance, small gaps around doors and windows could be required to allow for movement of the building when the home warms and cools in order to let them be closed and opened instead of than sticking. A good heating system is important to ensure healthy homes

Heating Te Marua

Rental properties in Te Marua must have a fixed source of heat that can warm the living room to at least 18degC, even on the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to be fixed (i.e. not portable) that is, at minimum 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to determine if your current fix heater(s) are adequate or if you’ll need to ‘top up’ by adding a second heater. Unflued combustion and open fire heaters, such as the portable LPG bottle heaters are not considered to be acceptable heating options for the Healthy Homes Standard.

If the heating that you offer is electric heating or heat source, it must have the thermostat. This will help make the heating more uniform and efficient. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps, pellet burners or flued gas heaters are required. In certain situations, such as small apartments the smaller fixed electric heater may suffice.

If your living space already has a permanent heating source, like heat pumps, it might need a top up to meet the standards. Some types of heaters can’t be used to meet the quality as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Te Marua

Every living space in a rental home must have at least one openable doors or windows to offer natural ventilation. Additionally, areas with high moisture spaces like kitchens and bathrooms need to have an externally vented extractor fan to get rid of moisture.

Insulation Te Marua

Underfloor and ceiling insulation is mandatory on all rental homes as of July 1st, 2019. Property managers and landlords must ensure the insulation meets standards that are in line with the latest standard. In certain situations, the current ceiling insulation, or the insulation of the subfloor space might need to be added or replaced.

A house that is well-insulated will reduce the risk of condensation and reduce the chances of mould and damp, and will also make more easy to allow the house to keep the heat.
