Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed for a Te Marua rental property, all Healthy Homes compliance tasks must be done by the end of 90 days.

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on the Te Marua rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.

Failure to meet each of Healthy Homes Standards inside of the expected timeframe can result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement there could be additional penalties or an infringement fee.

Any tenant can ask for information about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to provide the information requested within 21 days of getting the notice, the tenant can receive an infringement notice and be fined upto $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers who offer a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is the one who is named on the tenancy contract as the person leasing the property out It could also be the name of the landlord or the property management company.

All the information on the Compliance Statement needs to be accurate when the tenancy contract is signed, and ideally it should be maintained throughout the duration of the tenancy when any relevant work gets completed.

It’s important to note that a landlord with several rental properties can face additional fines for non-compliance. The most severe penalties are reserved only for serious violations. Those who have six or more properties can be fined as high as $50,000, and even as high as $100,000 in hearing claims.

Te Marua Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 and 30 , June 20,21

  • Underfloor and ceiling insulation is a requirement for all Te Marua and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included with any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their the conformance to any Healthy Homes Standard that apply or will apply throughout the tenancy period of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords have to make sure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder home tenancies) are required to comply with Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of when the tenancy began.
Unreasonable Gaps & Holes

Draught Stopping Te Marua

Draughts may lead to dropping temperatures within homes. A damp home will cost more to heat, resulting in wasted energy and incurring higher costs.

If a draft can be felt through gaps that are too large or holes that it needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air coming in or the air is clear out of a hole or gap or crack, then it is probably a gap or hole that needs sealing in somehow. Large cracks and gaps should be permanently stopped. Gaps greater than 3mm that let air into or out within your home need seals. For example, if an open fireplace is not in use, it could cause draughts, and must be sealed off. Property managers and landlords are accountable for making sure that these draughts are stopped as much as imaginable.

There is no need to block holes or gaps that are part of the building. For example, tiny gaps around windows and doors could be necessary to allow for the movement of the structure as the home heats and cools, to allow them to be shut and opened, rather instead of being stuck. Adequate heaters are important to ensure well-being houses

Heating Te Marua

Rental properties in Te Marua require a reliable source of heat that can heat the living space to at least 18degC even on the coldest winter days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health as well as their mental health.

The source of heating needs to be fixed (i.e., not portable), at minimum 1.5 Kilowatts in heating capacity and have the minimum heating capacity needed for the main living room. A Heating Assessment Tool may be used to determine if the current installed heater(s) are adequate or whether you will require to top up by adding a second heater. Fires that are open and unflued heaters like the portable LPG bottle heaters aren’t considered to be suitable heating options under The Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump it needs to include a thermostat. This will make the heating more consistent and efficient. For the majority of homes, bigger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, like small apartment buildings the smaller fixed electric heater may be sufficient.

If the main living room is already equipped with a fixed heating source such as heat pumps, it might just require an upgrade to meet the standards. Some types of heaters can’t be used to comply with the quality because they’re expensive, inefficient and/or unhealthy to run.

Ventilation Te Marua

Each living space within a rental house must contain at minimum one open doors or windows to offer natural ventilation. In addition, high moisture areas such as kitchens or bathrooms need to have an externally vented extractor fan to get rid of moisture.

It is the ventilation standard is all about recognising it is that dry air will be more easy to heat and that a property that is well ventilated will be less prone to developing damp and mould.

Bedrooms, living spaces, kitchens, and dining areas are considered liveable spaces. Connecting spaces like the hallway are not considered liveable , and thus do not require an opening window or door.

Each window, door or skylight requirements for them to be in a position to open to the outside, but remain closed in order to allow to circulate fresh air as well as ventilation.

All bathrooms and kitchens and every other room of your home with a bath, shower and cooktop or another water-generating appliance will need appropriate extractor fans which are vented towards the outside. Insulation Te Marua

Ceiling and underfloor insulation is a requirement to all rental homes as of July 1st, 2019. Property managers and landlords have to ensure that the insulation meets the new standard. In some cases, current ceiling insulation, or the insulation of the subfloor space may require to be filled with or replaced.

A well-insulated property can help control condensation, and decrease the risk of mould and dampness and also makes it easier to the home to hold heat.

The "R" stands for thermal resistance and is a measure of how well insulation is able to resist heat flow. The more high the R-value, higher the standard of insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – The rest part of North Island except Taupo and the Central Plateau – ceiling R 2.9 and floor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3 below floor R 1.3
