Fines for Failing to Comply

As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Te Marua rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement in all Te Marua and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included with any renewal, new or altered tenancy contract.

What are unreasonable gaps and holes?

If you can feel external air flowing in or an unobstructed draught coming from a gap or hole and you are able to feel it, it is likely a crack or hole which needs sealing in somehow. Large cracks and gaps should be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit of your home require the sealing. For example, if the open fireplace isn’t being used, it can create draughts. This should be blocked off. Property managers and landlords are responsible for ensuring such draughts are eliminated in the maximum extent imaginable.

Heating Te Marua

Te Marua rental properties should have a permanent source of heat that can warm the largest or main living space to at least 18degC, even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating needs for it to be permanent (i.e., not portable), at minimum 1.5 kW of heating capacity, and must meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool may be used to check if the current fix heater(s) are adequate or whether you will need to "top-up" with an additional heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered acceptable heating options in The Healthy Homes Standard.

If the heating that you provide is an electric heater (or heat pump), it must be equipped with a thermostat. This will help make your heating more consistent and effective. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are needed. However, in some cases such as small apartments, a smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source like heat pumps, it may require some additional energy to meet the standards. Certain types of heaters cannot be used to achieve the standard as they are either inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Te Marua

Every living space in the rental property should have at least one opening windows or an exterior door to provide natural ventilation. Additionally, areas with high moisture areas like kitchens and bathrooms should be equipped with an externally vented extractor to eliminate moisture.
