Fines for Failing to Comply

As of 1st July 2021, once a new or renewed tenancy is signed on a Totara Park rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

Since the 1st July of 2021, when a new or renewed Tenancy is signed for a Totara Park rental property, all Healthy Homes compliance work must be done by the end of 90 days.

The information contained in the Statement of Compliance requirements to be correct before the tenancy agreement can be signed, and ideally it is updated throughout the duration of the tenancy when any related work is completed.

It is important to be aware that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are given for serious violations, and landlords who own six or more properties can be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Totara Park Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 , June 20,21

  • Ceiling and underfloor insulation is required to all Totara Park and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Property managers and landlords are required to keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will apply during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers must ensure their rental properties conform to the Healthy Homes Standard within 90 days of a newly renewed, extended or changed lease.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes let by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rentals houses must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

Heating Totara Park

Rental properties in Totara Park should have a permanent source of heating that is able to heat the living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

If your main living space already has a central heating source like an air conditioner, it could need an upgrade to meet the standards. Some types of heaters can’t be used to achieve the standard since they’re either not effective, cost prohibitive to operate and/or unsafe to run.
