Fines for Failing to Comply
Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Totara Park rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there could be additional penalties or an infringement fee.
Anyone can request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager is unable to provide the required information within 21 days of receiving the request, they may receive an infringement notice and could be fined up to $750.
Furthermore, there’s also a penalty of up to $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as being the person letting the property out which could be the name of the landlord as well as the company that manages the property.
The information contained in the Compliance Statement needs to be current before the tenancy agreement can be signed. It is updated throughout the duration of the tenancy when any associated work has been completed.
It’s also crucial to note that a landlord who manage several rental properties can face more severe penalties for not complying. The highest penalties are given for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, or as high as $100,000 in hearing claims.
