Fines for Failing to Comply

The person who is liable to pay this fine is the one who is identified on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord, or the company that manages the property.

It is also important to keep in mind that a landlord who own multiple rental properties could face even higher fines for non-compliance. Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is mandatory to all Totara Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords must keep records of their conformance with all Healthy Homes Standard that apply or will apply to your rental home.

Beginning 1 July 2021

  • Private landlords and property managers have to make sure that their rental properties are in compliance according to Healthy Homes Standards within 90 days of a new, renewed , or altered Tenancy.
