Fines for Failing to Comply

The person liable for this fine is the person who is listed on the tenancy agreement as being the person renting the property It could also be the landlord’s name or the property management company.

The information contained in the Statement of Compliance needs to be accurate when the tenancy contract is completed, and is updated through the tenancy period as related work is completed.

It is important to note that landlords with multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are given for the most serious violations, and landlords who own six or more properties can be fined as high as $50,000 and as high as $100,000 in hearings.

Totara Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Totara Park and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
